What's in a Tenancy Agreement

A residential tenancy agreement should include:

  • Date of agreement
  • Names and address of both parties
  • Address of the property being rented
  • Term of tenancy (start date and end date)
  • Address of where the tenant is to pay rent
  • Amount of rent
  • Utilities that the tenant is responsible for
  • Names of permitted occupants and the maximum number of occupants allowed in the suite
  • The tenancy agreement can be written, oral, or implied. However, it is preferred to have it in writing.

    If there is a written tenancy agreement, the landlord must give a fully signed copy to the tenant within 21 days after signing.

    A tenancy agreement that has been signed and witnessed by the tenant and landlord becomes a legal document.
