
Notice of Rental Increase
- Landlords cannot increase the rent payable by a tenant under a fixed term or periodic tenancy agreement until a minimum of one year(365 days) has passed since the last increase or since the start of the tenancy, whichever is later. If the 365th day occurs during a fixed term tenancy the landlord cannot increase the rent until the tenancy agreement expires. In addition, no rental increases are permitted for either periodic or fixed term tenants if a tenant is served with a notice to terminate because the premises are being converted to condominiums or major renovations are required that need the premises to be unoccupied.
- A landlord must give written notice of rent increase:
- Weekly tenancy: must give 12 weeks notice
- Monthly tenancy: must give 3 months notice
